These Terms of Use (the “Terms”) form a legally binding agreement between you and Casitsu (“Casitsu,” “we,” “our,” or “us”) and govern your access to and use of the Casitsu website, any sub-domains, mobile versions, mobile applications, e-mail services, and all other services, features, or content we make available (collectively, the “Site” or “Services”).

By accessing, browsing, registering for, or otherwise using the Site you (i) represent that you are at least eighteen (18) years old (or the legal age of majority in your jurisdiction, whichever is higher), (ii) reside in the United States in a state or territory where participation in sweepstakes of this type is not prohibited, and (iii) have read, understood, and agree to be bound by these Terms and our [Privacy Policy]. If you do not agree, do not use the Site.

Notice Regarding Binding Arbitration & Class-Action Waiver:
These Terms contain a mandatory arbitration agreement and class-action waiver in Section 15. Except for certain types of disputes described there, you agree that any disputes between you and Casitsu will be resolved by binding, individual arbitration, and you waive any right to participate in a class-action lawsuit or class-wide arbitration.

1. Eligibility & Account Registration

1.1 Age & Residency. The Site is only intended for natural persons who are at least 18 years of age and located in a U.S. state or territory where sweepstakes participation is lawful. Void where prohibited.

1.2 Single Account Rule. You may register one (1) account per natural person. You must provide accurate, current, and complete information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

1.3 Suspension & Termination. We may suspend, restrict, or terminate your account or access to all or any portion of the Site at any time, with or without notice, for violation of these Terms, suspected fraud, or any other lawful reason.

2. Nature of the Services

2.1 Promotional Sweepstakes; No Real-Money Gambling. Casitsu operates a promotional sweepstakes platform where users collect Casitsu Coins (“Gold Coins”) and Sweepstakes Credits (“SC”) for entertainment. Gold Coins have no cash value and may only be used to play socially for fun. SC may be used to participate in sweepstakes promotions for a chance to win real-world prizes and/or cash-redeemable credits, subject to the Official Sweepstakes Rules (see Section 4).

2.2 No Purchase Necessary. A purchase does not increase your chances of winning. Alternate methods of free entry (“AMOE”) are always available and explained in the Official Rules.

2.3 Geolocation. We may use geolocation technology (including third-party services) to verify your physical location. You consent to this processing and acknowledge that failure to verify a permissible location may result in denied access.

3. License & Acceptable Use

3.1 Limited License. Subject to your ongoing compliance with these Terms, Casitsu grants you a personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Site for your own non-commercial entertainment.

3.2 Prohibited Conduct. You agree not to:

• Copy, modify, distribute, publicly display, or create derivative works from Site content without express written consent.

• Use any data-mining, scraping, robots, or similar data-gathering tools.

• Interfere with or disrupt the security, integrity, or performance of the Site.

• Circumvent, disable, or otherwise interfere with geolocation or age-verification measures.

• Engage in any fraudulent activity, collusion, or other behavior intended to manipulate sweepstakes outcomes.

• Use the Site in violation of any applicable federal, state, or local law or regulation, including U.S. sanctions laws.

4. Sweepstakes Promotions

4.1 Official Rules. Each sweepstakes promotion offered on the Site is governed by its own Official Rules, which are incorporated by reference into these Terms. If the Official Rules conflict with these Terms, the Official Rules control.

4.2 Winner Verification. Potential winners are subject to eligibility verification, which may include identity documentation (e.g., a government-issued ID), address confirmation, W-9 forms, and any tax-related forms required by law.

4.3 Taxes. You are solely responsible for all federal, state, and local taxes, fees, and surcharges associated with any prize.

4.4 Right to Modify or Cancel. Casitsu reserves the right to cancel, terminate, modify, or suspend any promotion if fraud, technical failures, or any other factors impair the integrity or proper functioning of the promotion.

5. Virtual Currency & Digital Items

5.1 Gold Coins. Gold Coins are virtual items used for casual play. They cannot be exchanged, sold, or redeemed for money or anything of monetary value.

5.2 Sweepstakes Credits (SC). SC may only be used to enter sweepstakes. SC have no monetary value except as provided in the Official Rules and may only be redeemed in accordance with those Rules.

5.3 No Proprietary Interest. You acknowledge that all virtual currencies and digital items are digital contractual licenses, not property, and may be revoked at any time without notice.

6. Intellectual Property

All content (including software, artwork, text, logos, and audio-visual materials) is owned by Casitsu or its licensors and is protected by U.S. and international intellectual-property laws. Except for the limited license granted in Section 3, you acquire no right, title, or interest in any content.

7. Third-Party Content, Links & Advertising

The Site may feature third-party content, links, or ads (“Third-Party Materials”). Casitsu does not control or endorse Third-Party Materials and is not responsible for any loss or damage arising from your reliance on them. Your dealings with third parties are solely between you and the third party.

8. User-Generated Content

8.1 License. If you post, upload, or submit content to the Site (“User Content”), you grant Casitsu a worldwide, non-exclusive, royalty-free, perpetual, transferable, sublicensable license to use, display, reproduce, modify, and distribute that content in connection with the Site and our marketing.

8.2 Standards. You agree that your User Content will not be illegal, infringe any third-party rights, contain viruses or malware, or be obscene, hateful, or otherwise objectionable. We may remove or disable any content at our discretion.

9. Disclaimers

9.1 No Warranty. THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” CASITSU MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES.

9.2 No Gambling Advice. Content is for entertainment and informational purposes only and is not intended as legal, financial, or gambling advice.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CASITSU (INCLUDING ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

CASITSU’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED ONE THOUSAND U.S. DOLLARS (US $1,000).

Some jurisdictions do not allow certain limitations, so the above may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless Casitsu and its affiliates from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Site; (b) your violation of these Terms or any law; or (c) your User Content.

12. Privacy

Your use of the Site is also governed by our [Privacy Policy], which explains how we collect, use, and disclose personal information. By using the Site, you consent to our data practices.

13. Changes to Terms

We may revise these Terms at any time. When we do, we will post the updated Terms and update the “Last Updated” date. Changes will become effective ten (10) days after posting unless a shorter period is required by law. Continued use after that date constitutes acceptance of the revised Terms.

14. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or if required by law. Upon termination, all licenses granted to you cease immediately.

15. Dispute Resolution & Arbitration

15.1 Informal Negotiations. You agree to attempt to resolve any dispute informally by contacting [email protected]. If we cannot resolve it within sixty (60) days, either party may initiate arbitration.

15.2 Binding Arbitration. All claims (except those expressly excluded) will be resolved by confidential, binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration will take place in the U.S. county where you reside or another mutually agreed location.

15.3 Class-Action Waiver. Arbitration will be conducted only on an individual basis; class actions and class arbitrations are not permitted.

15.4 Exceptions. You or Casitsu may seek relief in small-claims court for qualifying matters or in court for injunctive relief to stop unauthorized use or intellectual-property infringement.

16. Miscellaneous

• No Waiver. Failure to enforce any provision shall not constitute a waiver.

• Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.

• Assignment. You may not transfer your rights or obligations under these Terms. Casitsu may assign its rights and obligations without restriction.

• Entire Agreement. These Terms (including the Privacy Policy and Official Rules) are the entire agreement between you and Casitsu regarding the Site.
